1. Purpose

These terms and conditions of use (hereinafter the “Terms”) define the terms and conditions for using the TamTam mobile application and associated services (hereinafter the “Service”), published by TamTam Care SRL, a company incorporated under Belgian law (hereinafter “TamTam”, “we”, “our” or “us”).

TamTam is a simplified communication service designed to enable elderly people to stay in touch with their family and loved ones. The Service includes a mobile application for seniors, an administration interface for caregivers, and a web messaging portal.

2. Acceptance of the Terms

Use of the Service implies full and complete acceptance of these Terms. If you do not accept all of these Terms, you must not use the Service.

By creating an account or using the Service, you acknowledge that you have read, understood and accepted these Terms as well as our Privacy Policy.

3. Description of the Service

TamTam offers two levels of service:

3.1 Senior application (free)

The senior application is entirely free and includes the following features:

  • Simplified interface with a main button leading to 4 essential actions.
  • Voice and text messaging with loved ones.
  • Medication reminders (informational only).
  • Event and appointment calendar.
  • SOS emergency button with location transmission.
  • Daily check-in to reassure loved ones.

3.2 Care Circle subscription (caregivers)

The Care Circle subscription is intended for caregivers and family members who wish to manage the senior’s family circle. It includes:

  • Complete administration dashboard.
  • Management of the senior’s contacts, medications and calendar.
  • Check-in and SOS alert notifications.
  • Enhanced messaging with the senior.
  • Family circle management (invitations, roles).
  • Priority support.

4. Registration and account

4.1 Registration conditions

  • You must be at least 18 years old to create a TamTam account.
  • You agree to provide accurate, complete and up-to-date information when registering.
  • You are responsible for the confidentiality of your login credentials (email and password).
  • You must inform us immediately of any unauthorised use of your account.

4.2 Senior account

The senior account may be created by the senior themselves or by a caregiver with the senior’s consent. The caregiver who creates the account is responsible for ensuring that the senior understands and accepts these Terms.

4.3 Invitation code

Access to the Service may require an invitation code provided by a caregiver with an active Care Circle subscription. This code is used to link the senior to an existing family circle.

5. Care Circle subscription

5.1 Pricing

  • Monthly subscription: EUR 6.99 per month.
  • Annual subscription: EUR 59.99 per year (i.e. EUR 5.00 per month).
  • Prices are inclusive of all taxes (VAT included).

5.2 Free trial period

All new subscribers benefit from a 14-day free trial period. During this period, you may cancel at any time without being charged. At the end of the trial period, the subscription will be automatically converted to a paid subscription, unless cancelled beforehand.

5.3 Renewal and cancellation

  • The subscription renews automatically at the end of each period (monthly or annual), unless cancelled by the user.
  • You may cancel your subscription at any time from the application settings or via your app store settings (App Store or Google Play).
  • Cancellation takes effect at the end of the current subscription period. You retain access to premium features until that date.
  • No pro-rata refund is granted for the remaining period, except as provided by law.

5.4 Right of withdrawal

In accordance with Belgian and European law, you have a 14-day right of withdrawal from the date of subscription. To exercise this right, contact us at contact@tamtamcare.com. If you have consented to the immediate performance of the Service during the withdrawal period and the Service has been fully performed, the right of withdrawal no longer applies.

5.5 Price changes

We reserve the right to modify the Care Circle subscription prices. Any price change will be notified at least 30 days before it takes effect. If you do not accept the new price, you may cancel your subscription before the effective date of the change.

6. User obligations

By using the Service, you agree to:

  • Use the Service lawfully and in accordance with these Terms.
  • Not use the Service for illegal, fraudulent or harmful purposes.
  • Not transmit illegal, defamatory, abusive, obscene, threatening content or content that infringes the rights of others.
  • Not attempt to gain unauthorised access to TamTam’s or its users’ systems, networks or data.
  • Not disrupt or compromise the operation of the Service.
  • Respect the intellectual property rights of TamTam and third parties.
  • Not create fake accounts or impersonate another person.
  • Treat other users with respect and kindness.

In the event of a breach of these obligations, we reserve the right to suspend or delete your account, without notice or compensation.

7. Intellectual property

All elements composing the Service (software, interface, text, graphics, images, sounds, logos, trademarks, database) are the exclusive property of TamTam Care SRL or its licensors, and are protected by Belgian, European and international intellectual property laws.

The “TamTam” trademark and associated logo are trademarks of TamTam Care SRL. Any unauthorised reproduction, representation or use of these elements is prohibited.

Use of the Service does not confer any intellectual property rights over the Service or its content. You are only granted a personal, non-exclusive, non-transferable and revocable licence to use the Service in accordance with these Terms.

8. Limitation of liability

8.1 Nature of the Service

TamTam is a communication and daily organisation tool. TamTam is not a medical device within the meaning of Regulation (EU) 2017/745 and must not be used as such.

8.2 Medication reminders

The medication reminders offered by the Service are provided for purely informational purposes. They serve as memory aids and:

  • Do not constitute medical advice, a diagnosis or a prescription.
  • Do not replace consultation with a doctor or pharmacist.
  • Do not guarantee the accuracy, completeness or currency of information entered by the user.
  • May be subject to delays related to push notifications, network connectivity or device status.

TamTam disclaims all liability in the event of non-receipt of a reminder, failure to take medication or any consequence related to the use or non-use of this feature.

8.3 SOS function

The SOS function allows you to send an alert to designated emergency contacts. This function:

  • Does not replace official emergency services (112 in Europe, 101/100 in Belgium).
  • Depends on the device’s Internet connectivity.
  • Does not guarantee that emergency contacts will receive or read the alert immediately.

In the event of a real medical emergency, always call the emergency services by dialling 112.

8.4 Service availability

We strive to ensure the continuous availability of the Service. However, we do not guarantee 100% availability. The Service may be temporarily interrupted for maintenance, updates or in the event of force majeure. We cannot be held liable for damages resulting from Service unavailability.

8.5 Disclaimer of warranties

The Service is provided “as is” and “as available”. To the extent permitted by law, we exclude all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.

8.6 Liability cap

To the extent permitted by Belgian law, the total liability of TamTam Care SRL towards you, regardless of the cause, is limited to the total amount you have paid for the Service during the 12 months preceding the event giving rise to liability. This limitation does not apply in the event of wilful misconduct or gross negligence on our part, or to personal injury.

9. Personal data

The collection and processing of your personal data are governed by our Privacy Policy, which forms an integral part of these Terms. We invite you to read it carefully.

10. Termination

10.1 Termination by the user

You may delete your account at any time from the application settings. Deletion of your account results in:

  • Termination of your Care Circle subscription (if applicable).
  • Deletion of all your personal data within 30 days, subject to legal retention obligations.
  • Loss of access to all Service features.
  • Deletion of your message history and reminders.

10.2 Termination by TamTam

We reserve the right to suspend or terminate your account in the event of:

  • Breach of these Terms.
  • Fraudulent or abusive use of the Service.
  • Prolonged account inactivity (more than 24 months without login), after prior notification by email.

11. Applicable law

These Terms are governed by Belgian law. The mandatory provisions of European Union consumer law and the consumer law of your country of residence apply in the cases provided for by law.

12. Competent jurisdiction

In the event of a dispute relating to the interpretation or performance of these Terms, the parties will endeavour to find an amicable solution. Failing amicable agreement, the courts of Brussels (Belgium) shall have sole jurisdiction, without prejudice to the consumer’s right to bring proceedings before the court of their domicile in accordance with applicable mandatory rules.

13. Changes to the Terms

We reserve the right to modify these Terms at any time. In the event of a material change, we will notify you by notification in the application or by email at least 30 days before the changes take effect.

Continued use of the Service after the changes take effect constitutes acceptance of the modified Terms. If you do not accept the new Terms, you must stop using the Service and delete your account.

14. General provisions

  • Entirety: these Terms, together with the Privacy Policy, constitute the entire agreement between you and TamTam Care SRL regarding the use of the Service.
  • Severability: if any provision of these Terms is declared null or unenforceable, the remaining provisions shall remain in force.
  • Waiver: failure to exercise a right provided for in these Terms does not constitute a waiver of that right.
  • Assignment: you may not assign your rights and obligations under these Terms without our prior written consent.
  • Force majeure: TamTam Care SRL shall not be held liable for any failure to perform its obligations resulting from a force majeure event.
